We are not associated with any company that uses aggressive and intrusive sales tactics that can/may mislead and misrepresents customers. In Canada, telemarketing is regulated by the Federal government of Canada. The department specifically in charge is the Canadian Radio-television and Telecommunications Commission, usually abbreviated CRTC.

 

These are rules that all telemarketers must follow for calls within Canada:

  • Callers must identify the person or organization they represent.
  • Upon request, callers must provide the telephone number, name and address of a responsible person the called party can write to.
  • Callers must display the originating calling number or an alternate number where the caller can be reached (except where the number display is unavailable for technical reasons).
  • Names and numbers of called parties must be removed within 30 days of the called party’s request.
  • DO NOT CALL lists are to be maintained by the calling party and remain active for three years.
  • A telemarketing telecommunication is restricted to the following hours: 9:00 a.m. to 9:30 p.m. on weekdays (Monday to Friday); and 10:00 a.m. to 6:00 p.m. on weekends (Saturday and Sunday), in which the hours refer to those of the consumer receiving the telemarketing telecommunication.
  • Sequential dialing is not permitted.
  • Calls are not permitted to a emergency line or healthcare facilities.
  • Random dialing and calls to non-published numbers are allowed.

 

Steps to Keep Telemarketers from Calling in Ontario

  • Register for the National Do Not Call List by calling (866) 580-3625. Instructions are provided at the time you place your call. There is also a website available to register online (see Resources).
  • Verify that your cell, home, and fax number is listed by calling (866) 580-3625 a few days after placing your numbers on the Do Not Call list. If your numbers have not been placed on the list, add them again. Numbers should be added to the list within 24 hours of registration.
  • Renew your registration every three years and register any new numbers you may get. If you change your telephone number, the new number will not automatically be added to the list.
  • Remember there are exceptions to the types of corporations that can still contact you. Charities can call to ask for donations. Survey companies can call and ask for your participation. Political parties can call and ask for public support in upcoming elections. Companies you have done business with in the past 18 months can also contact you.
  • Stop the calls from exempted organizations. Even the calls from the organizations that are allowed to contact you can be stopped. You have the right to ask those companies to place you on their own do-not-call lists. Canadian law requires that each telemarketer in Canada must respect your wishes to not be contacted.
  • Report any unsolicited calls to the National Do Not Call List operator by calling (866) 580-3625. Telemarketers are required by law to ensure the numbers on the list are not called. They have access to a database with phone numbers that are registered. Penalties for not adhering to this law include a $1,500 fine for individuals and a $15,000 fine for corporations.

What is the National Do Not Call List?

The National Do Not Call List (DNCL) gives consumers a choice about whether to receive telemarketing calls. The National DNCL Rules introduce new responsibilities for Canada’s telemarketers.
